       EXPLORING CRITICAL CRIMINAL PROCEDURAL



       LAW (2017 ONWARDS)




       This  research  aims  to  develop  the  notions  of  critical  criminal  law.  The
       conventional  expositions  in  criminal  law  in  India  do  not  offer  causal,  critical,

       functional  and  radical  insights  into  the  manner  in  which  the  law  is  conceived,
       designed,  applied  and  interpreted.  Therefore,  this  study  attempts  to  resolve  the
       many complex issues which emerge from the interaction of criminal law with its

       stakeholders  in  India.  A  plain  implementation  and  interpretation  cannot  answer
       these  issues.  This  study  also  intends  to  identify  and  document  the  critical
       perspectives  which  are  relevant  to  criminal  procedural  law  by  examining  policy

       critique  by  thinkers  and  activists,  critique  by  judges  in  their  judgements  and
       critique by jurists about the institutions of criminal law. In this undertaking, the
       objective  is  to  develop  normative,  institutional  and  social  critiques  of  criminal

       procedural  law.  A  set  of  propositions  leading  to  the  development  of  a  robust
       theory of criminal law will be prepared by collating and combining the systematic
       analysis of all these categories.
